These Terms and Conditions apply to all products, offers, purchases and agreements made through Marie & Fiona Dublin.

Before completing a purchase, customers are given the opportunity to review these Terms and Conditions.

By placing an order, customers confirm that they have read and accepted these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Nothing in these Terms and Conditions limits or excludes any rights granted to consumers under applicable Irish or European Union consumer protection legislation.

Article 4 – Products and Offers

Marie & Fiona Dublin aims to provide accurate descriptions, photographs and information for all products available on our website.

Every product listing includes relevant information, such as available sizes, colours, materials and prices.

We make reasonable efforts to ensure that product images accurately represent the items being sold. However, colours may appear slightly different depending on the customer's screen settings.

All offers are subject to availability.

Where an offer is available for a limited period or subject to specific conditions, this will be clearly stated.

We reserve the right to update product information, availability and prices before an order is accepted.

Any additional delivery charges, taxes or import-related costs payable by the customer will be clearly disclosed where required by applicable law before the purchase is completed.

Obvious errors in product descriptions or prices may be corrected, subject to applicable consumer protection laws.

Article 5 – The Agreement

A customer places an order by selecting products and completing the checkout process.

After placing an order, the customer will receive an electronic confirmation acknowledging receipt of the order.

An order is accepted when Marie & Fiona Dublin confirms acceptance or dispatches the products, as explained during checkout.

We use appropriate security measures to protect customer information and electronic payments.

Marie & Fiona Dublin reserves the right to refuse or cancel orders where there are reasonable grounds to do so, including suspected fraud, payment issues or unavailable products.

If an order is cancelled after payment has been received, the customer will receive a refund in accordance with applicable law.

All orders are subject to product availability.

Article 6 – Right of Withdrawal

Customers purchasing products from Marie & Fiona Dublin have a 30-day return period.

This period begins on the day after the customer, or a person nominated by the customer, receives the product.

Customers may request a return within 30 days of receiving their order without providing a reason.

To exercise this right, customers must clearly inform Marie & Fiona Dublin of their decision to cancel the purchase.

Customers may submit their request through our website's contact form or through the return process described in our Returns and Refunds Policy.

After receiving a return request, we will provide the customer with the necessary return instructions.

Customers must return the products within 30 days of notifying us of their decision to cancel.

Products should be handled with reasonable care and returned with their original accessories and packaging where reasonably possible.

Customers may inspect and try on clothing as they would in a physical shop. Any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods may be deducted from the refund where permitted by law.

Customers should retain proof of return postage until their return has been processed.

Article 7 – Return Costs and Refunds

Customers are responsible for the direct cost of returning products when exercising their right of withdrawal, provided this cost was disclosed before purchase.

If a product is faulty, damaged, incorrect or does not conform to the contract, Marie & Fiona Dublin will provide the appropriate remedy in accordance with applicable consumer law, without charging the customer return costs where prohibited by law.

Once a valid cancellation request has been received, refunds will be processed without undue delay and no later than 14 days after notification of cancellation.

For returned goods, we may withhold the refund until the products have been received or the customer has provided evidence of having returned them, whichever occurs first.

Refunds will be issued using the original payment method unless the customer expressly agrees otherwise.

Where legally required, refunds will include the standard delivery cost originally paid by the customer. Additional charges for premium delivery services are not refundable unless required by law.

Article 8 – Exceptions to the Right of Withdrawal

The right of withdrawal may not apply to certain products where an exception is permitted under Irish and European Union consumer law.

These may include:

  • Products made to the customer's specifications or clearly personalised.

  • Sealed products that are unsuitable for return for health protection or hygiene reasons, where the seal has been broken after delivery.

  • Products that, by their nature, become inseparably mixed with other items after delivery.

Any applicable exception will be clearly communicated before the customer completes the purchase.

These exceptions do not affect statutory rights relating to faulty or non-conforming products.

Article 9 – Prices

All product prices are displayed in euros (€), unless otherwise indicated.

Any applicable taxes and mandatory charges will be included in the displayed price or clearly disclosed before checkout, as required by law.

Delivery costs, where applicable, will be shown before the customer completes their purchase.

Marie & Fiona Dublin reserves the right to change product prices at any time. However, changes will not affect orders that have already been accepted.

Promotional prices and discounts are valid only during the stated promotional period and are subject to the conditions of the offer.

If a product is reduced in price after a customer has purchased it, the customer is not automatically entitled to a refund of the difference.

We make every effort to ensure accurate pricing. In the event of an obvious pricing error, we may contact the customer to resolve the issue in accordance with applicable law.

Article 10 – Product Quality and Guarantees

Marie & Fiona Dublin aims to provide products that meet the descriptions, specifications and quality standards stated on our website.

All products must comply with applicable Irish and European Union consumer protection legislation.

Customers have statutory rights when products are faulty, not as described or otherwise fail to conform to the contract.

Where a product is faulty or incorrect, customers should contact our customer service team and provide relevant information about the issue.

Depending on the circumstances and applicable law, customers may be entitled to a repair, replacement, price reduction or refund.

Any additional commercial warranty provided by Marie & Fiona Dublin or a manufacturer does not affect the customer's statutory rights.

Normal wear and tear, accidental damage and damage caused by misuse are not generally covered by commercial warranties, unless otherwise required by law.

Article 11 – Delivery and Fulfilment

Marie & Fiona Dublin takes reasonable care when processing, preparing and dispatching customer orders.

Orders will be delivered to the shipping address provided by the customer during checkout.

Estimated delivery times will be communicated through our website, checkout or shipping confirmation.

We aim to fulfil orders within the communicated delivery timeframe.

Unless a different delivery period has been agreed, goods will be delivered without undue delay and within 30 days of the contract being concluded, in accordance with applicable consumer law.

If delivery is delayed, customers will be informed where reasonably possible.

Where an order cannot be fulfilled, we will notify the customer and arrange an appropriate refund or alternative solution.

Customers will not be required to accept substitute products without their agreement.

The risk of loss or damage generally remains with Marie & Fiona Dublin until the customer, or a person nominated by the customer, takes physical possession of the goods, subject to applicable legal exceptions.

Article 12 – Ongoing Agreements, Duration and Cancellation

Where Marie & Fiona Dublin offers subscriptions, recurring deliveries or other ongoing agreements, the specific duration, payment terms and cancellation conditions will be clearly communicated before purchase.

Customers will be informed of any automatic renewal arrangements where applicable.

Customers may cancel ongoing agreements in accordance with the agreed terms and applicable Irish consumer protection law.

Any cancellation conditions must be fair, transparent and clearly explained.

This article does not affect the statutory cancellation rights applicable to individual purchases.

Article 13 – Payment

Payment for orders must be completed using one of the payment methods available at checkout.

Customers are responsible for providing accurate billing and payment information.

Marie & Fiona Dublin uses secure payment processing methods to protect customer transactions.

An order may be delayed or cancelled if payment cannot be successfully processed.

Customers should notify us as soon as possible if they identify an error in their payment details or transaction.

Any additional payment charges will be disclosed before purchase and must comply with applicable law.

Article 14 – Complaints Procedure

Marie & Fiona Dublin is committed to providing a positive shopping experience and resolving customer concerns fairly.

Customers who experience a problem with an order, delivery or product are encouraged to contact our customer service team.

Complaints should include relevant details, such as the order number, a description of the issue and supporting photographs where appropriate.

We aim to respond to complaints within 14 days of receiving them.

If additional investigation is required, we will provide an update and an estimated timeframe for resolution.

Where a complaint is justified, we will offer an appropriate solution in accordance with applicable consumer law.

Customers retain all statutory rights and may pursue available dispute resolution procedures where necessary.

Article 15 – Applicable Law and Disputes

These Terms and Conditions are governed by the laws of Ireland.

Any disputes arising from purchases made through Marie & Fiona Dublin will be handled in accordance with applicable Irish law.

Nothing in these Terms and Conditions limits any mandatory consumer protections available under Irish or European Union law.

We encourage customers to contact our customer service team first so that concerns can be resolved fairly and efficiently.

Where a dispute cannot be resolved directly, customers may pursue any available legal or alternative dispute resolution procedures.

Article 16 – SMS Marketing

By voluntarily subscribing to SMS marketing from Marie & Fiona Dublin, customers agree to receive promotional text messages, special offers, product updates and other marketing communications, in accordance with applicable data protection and electronic marketing laws.

Customers may also receive transactional messages relating to their orders, including order confirmations and delivery updates, where appropriate.

Marketing messages will only be sent where we have a valid legal basis to do so.

Consent to receive marketing messages is not a condition of making a purchase.

The frequency of marketing messages may vary.

Customers may withdraw their marketing consent at any time by replying STOP to a marketing message where this option is supported, using the unsubscribe instructions provided, or contacting our customer service team.

Standard mobile network charges may apply depending on the customer's mobile provider.

Marie & Fiona Dublin does not charge customers separately for receiving our SMS marketing messages.

We may use authorised third-party service providers to manage SMS communications, subject to applicable data protection requirements.
